This website is operated by Alstons Confectionery. Throughout the site, the terms “we”, “us” and “our” refer to Alstons Confectionery. Alstons Confectionery offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Orders
Alstons Confectionery offers next day delivery for orders placed by 11am Monday to Friday. Please note this is not a guaranteed service. We are unable to arrange delivery on Bank Holidays or the next working day following a Bank Holiday. We use a third party courier to fulfil deliveries. This is a trackable service with reputable couriers. We cannot guarantee delivery times or dates due to events outside of our control therefore we recommend delivery the day before any special occasions. The date and time of delivery shall not be the essence of the contract and any failure to make delivery on any particular date shall not entitle the customer to refuse the delivery or to claim for a refund of the brownies, any expenses, loss of profits or other consequential losses whatsoever. Ownership of the goods will pass to the customer on receipt of payment and dispatch of the goods. We will inform you as soon as possible if the goods you have ordered are not available. Once Alstons Confectionery have dispatched the goods to our third party courier, we cannot be held responsible for any failure on their part to deliver.
It is the customer’s responsibility to ensure all delivery address details for the recipient given are correct. Alstons Confectionery cannot accept any responsibility or costs for non delivery to the intended recipient or losses in such circumstances.
On the day of dispatch a notification will be emailed containing tracking information. On the day of delivery, our third party couriers will provide an estimated delivery window by email or SMS (to the details provided at the time of ordering). This is intended as useful information, it is not a guaranteed delivery slot. If no one is home to take delivery, the courier will attempt to leave the parcel in a safe place or with a neighbour. If in the judgement of the delivery driver there is no obvious safe place to leave the parcel, a card will be left or electronic notification (email or SMS) will be sent to the sender to rearrange delivery and the parcel will be returned to the depot. It is the recipients responsibility to make contact by calling the phone number on the card to re-deliver the gift on another day or make a selection based on the electronic notification. Alstons Confectionery cannot accept responsibility or costs for deliveries where the recipient has not initiated contact with the courier to rearrange delivery; this remains wholly the responsibility of the recipient. If being purchased as a gift, Alstons Confectionery strongly recommends that the sender advises the recipient to expect a delivery.
Ensuring that the recipient is going to be at the delivery address, on the day of delivery, remains the responsibility of the sender. Alstons Confectionery cannot accept responsibility or costs incurred in such circumstances. Alstons Confectionery cannot accept responsibility or any costs incurred as the result of a delay in delivery by the third party courier due to adverse weather conditions or accident. In such cases a complimentary online credit voucher for the value of the carriage will be offered as a gesture of goodwill. Where damage has occurred to the products due to a delay with delivery or due to courier handling, a replacement will be dispatched immediately or on a future occasion of the the recipient’s choosing.
All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
Amendments can be made up to the point at which you click on ‘submit’ on the final page of our ordering process. It may be possible to amend a submitted order by contacting enquiries@alstonsconfectionery.co.uk. This is entirely at our discretion.
We ensure that all our products leave Alstons Confectionery in perfect condition. In the unlikely event you are unhappy with the product or service received please contact us via email to enquiries@alstonsconfectionery.co.uk within 48 hours of receiving the item or the expected delivery date. We may ask you to send photographs of the delivery contents and packaging. Please do not dispose of the contents or the packaging until you have received a response from us. We may need to investigate or provide additional evidence to our couriers. In the event of a damaged delivery, a replacement will be offered immediately or on a convenient future occasion. Your statutory rights are unaffected.
Returns Policy
As per distance selling regulations, due to the perishable nature of our products, we are unable to accept returns. If you find your order damaged or you have received the wrong product please contact us immediately. The remedies available are immediate replacement or credit for a future occasion depending on circumstances. Should you be unsatisfied in any way with your purchase or gift please contact us. Your statutory rights are unaffected.
Website content
Alstons Confectionery has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and all products have been accurately and fairly described. Packaging may vary from that shown. We have made every effort to display as accurately as possible the colours of our products that appear on the website, however as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery. Alstons Confectionery reserves the right to change the decoration on each brownie with an appropriate substitute of equal appeal and quality.
To the extent permitted by applicable law, Alstons Confectionery disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Alstons Confectionery shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
Ingredients
All our products are freshly made to order using the finest ingredients. Some of our products contain nuts, these are clearly noted in the descriptions. We make every effort to avoid contamination of nut based products in the kitchen, however as nuts are present and may have been present in the manufacture of our ingredients, this cannot be guaranteed. It is often possible to produce equivalent products avoiding certain ingredients, for example wheat or dairy. We may be able to remove or substitute ingredients for customers with allergies or intolerances. Please contact us at enquiries@alstonsconfectionery.co.uk prior to ordering with any allergen queries.
